Terms of use

These terms govern your use of the messaging services provided by SMSAPI (Chandnas IT Consultants), the continuation of Priority SMS. By creating an account or sending through us, you agree to them.

Acceptance of terms

By using our website, signing up, or sending messages through SMSAPI, you accept these terms on behalf of yourself and the organisation you represent. If you do not agree, do not use the service.

Accounts and access

Sending is provisioned through our telecom partner's dashboard. You are responsible for keeping your account credentials and API keys secure and for all activity that takes place under your account.

Your compliance responsibilities

Indian messaging is regulated by TRAI under the TCCCPR. As the sender, you are responsible for:

  • Completing DLT registration for your principal entity, headers and content templates before sending.
  • Obtaining and retaining valid consent from every recipient you message.
  • Ensuring the content you send is lawful, accurate and matches your registered templates.
  • Honouring opt-out requests and NDNC (National Do Not Call) preferences.

Consent and opt-out

You may only send to recipients who have consented to hear from you, and you must give them a working way to opt out. Opt-out requests, whether received by you or reported to us at support@smsapi.in, must be actioned promptly.

Prohibited use

You may not use the service to send unsolicited or spam messages, or content that is unlawful, misleading, or prohibited by regulation — including gambling, lottery and betting content where restricted, and any content that infringes another party's rights.

Suspension and termination

We may suspend or terminate your account without prior notice if we reasonably believe you have breached these terms, sent non-compliant or spam traffic, or exposed us or our partners to regulatory action. Fees for services already used are not refundable in these circumstances.

Responsibility for your traffic

You are responsible for the messages you send. Where a third party sends through your account, or your traffic causes a regulatory violation, complaint or penalty, that responsibility and any resulting liability rest with you.

Limitation of liability

The service is provided on a reasonable-efforts basis. To the extent permitted by law, SMSAPI is not liable for indirect or consequential losses, or for delivery failures caused by operators, regulators, or factors outside our control.

Governing law

These terms are governed by the laws of India, and the courts at Jaipur, Rajasthan have jurisdiction over any dispute arising from them.

Changes to these terms

We may update these terms as our services or the law change. Continued use after an update means you accept the revised terms. The date at the top of this page shows when it was last updated.
